Qui , aux premiers rougeoiements de l’automne d’une existence , n’a éprouvé le besoin de se retourner avec cette question : «  qu’ai-je fait de ma vie ? »

C’est la réponse qu’a choisi d’apporter sur la sienne , Maître Fathi Kemicha , avec un style sans emphase , clair et vivant, dans cet ouvrage qui, plus qu’un recueil de souvenirs , est une leçon de vie et une raison d’espérer.

La curiosité toujours en alerte , l’enthousiasme constamment entretenus-antidotes puissants au vieillissement – y côtoient l’ouverture aux autres , un irrépressible optimisme et la permanence de l’éthique sans laquelle aucune action , aucun comportement ne valent.

Y sont célébrés l’amour filial , le culte de la famille et les vertus de la chance à condition de la saisir sans atermoyer.

L’auteur prend le lecteur par la main avec simplicité et bonhomie pour lui faire suivre le parcours étonnant et atypique d’un juriste , d’un avocat à qui il a été donné de rencontrer les plus hauts personnages qui deviendront ses  amis.

Appelé à juger comme arbitre des différends aux enjeux immenses, avec en permanence en tête , la double exigence de l’indépendance et de l’impartialité, Maître Kemicha fut avant tout un avocat.

Tantôt défenseur des humbles et intervenant dans des dossiers courants devant les juridictions ordinaires , tantôt en charge des intérêts de grands groupes industriels , il fut même appelé à participer à la défense des intérêts d’états souverains devant les juridictions internationales les plus élevées .

Pris par ce récit à rebondissements, le lecteur attend avec gourmandise , de connaître au fil des pages , quelles nouvelles et hautes responsabilités seront confiées à cet homme à qui le travail acharné ne pèse pas , lui qui n’y voit que motif de satisfaction et source de joie de vivre.

Avec l’amour de la France et dans l’attachement à ses racines tunisiennes , Maitre Fathi Kemicha met sa carrière exceptionnelle et son expérience unique au service de l’avenir en recommandant à la jeunesse  … « de persévérer et d’y croire » .

Biographies are sometimes referred to in English as “a life”. We thus speak of Boswell’s unique “life of Johnson”, or Sandburg’s singular “life of Lincoln”. But for some subjects this word just doesn’t fit. Whether such subjects achieved great fame or instead followed a path of quieter but unconventional variety, it would be incongruously reductionist to speak of their life in the singular, because they have refused to follow a single path and therefore experienced a world without fences.

This modest but affecting volume comprises some highlights of the seemingly several lives of Fathi Kemicha, a man of more than a single culture, and more than a single path in life. Artist, lawyer, farmer, author of a thousand-page doctoral thesis at the university of Paris, visiting scholar at Yale … son and father. Tunisian and French, to be sure, but also importantly engaged in many other environments, from Bahrain in the east to Washington in the west – never limited by boundaries and therefore at home in the both private and public sectors … and ready when the time came, without manifesting any sense of a final port of call, to “cultiver son Jardin”. His is, above all, the story of a man and his relations with those whom he encountered on his path, friends to be enjoyed, all others to be given a chance…. and maybe become friends.

This preface will not anticipate the author’s own account of his journey and his discoveries. It will however make an observation which is absent there. While he mentions his role as an advocate before the World Court in The Hague in the remarkable case of Qatar v Bahrain, those who observed him there will remember his presentation of Bahrain’s arguments on the possible relevance of the doctrine of Uti Possidetis, of fundamental importance to lawyers in the post-colonial world, which did not fail to capture the attention of learned commentators, such as that of Professor Emmanuel Decaux in ”Affaire de la délimitation maritime et des questions territoriales entre Qatar et Bahraïn, Fond(arrêt du 16mars 2001”,: 2001 Annuaire Français de Droit International 177.

كان الكتـاب وسـيبقى قبلـة كل راغـب فى العلـم والمعرفـة ، واقتنـاؤه غايـة كل حريــص علــى تشــكيل الفكــر وإثــراء العقــل ، وهكــذا جــاءت رؤيــة مؤلـف هـذا الكتـاب الـذي أراد عبـر صفحاتـه أن ينقـل إلـى القارئ دروسـا مـن مسـيرته المهنيـة وتجربتـه الحياتيـة المتفـردة التـي تـروي رحلـة عطـاء لرجـل قانـون حقـق نجاحـا باهـرا بالمثابـرة والجهـد والشـغف بالعمـل.

لقــد اختــار الدكتــور فتحــي كميشــة عنوانــا مميــزا لســيرته الذاتيــة اسـتطاع مـن خلالـه أنـه يربـط بـن رحلـة مضـت – بـا حملتـه مـن نضـوج فكــري بعــد عمــر طويــل حافــل بالمواقــف – ومســتقبل آت بــا يحملــه مـن تطلعـات وآمـال. ولذلـك، فنحـن أمـام سـيرة ذاتيـة غيـر تقليديـة ولا نمطيـة يتعـرف عـن طريقهـا القـارئ علـى محـام عابـر للقـارات يسـرد لنـا حياتـه الفكريـة ورؤاه ونظرتـه إلـى الحيـاة مـن خـلل المواقـع التـي شـغلها والاماكـن الحيويـة التـي زارهـا وعمـل بهـا، فهـي ليسـت سـيرة عـن تطـور شـخص مـن الطفولـة إلـى الشـيخوخة، وإنـما هـي سـيرة عـن تطـور فكـره في المجـال القانونـي، ومـا أندرهـا في عالمنـا العربـي.

ويأخـذك المؤلـف في هـذا الكتـاب إلـى الغـوص معـه في أعمـاق شـخصيات قانونيــة لهــا قيمتهــا ومكانتهــا، كمــا ينقلــك عبــر الزمــان والــكان إلــى بيئــات قانونيــة متباينــة بختلــف أرجــاء المعمــورة وإلــى مواقــع يتشــوق رجـل القانـون إلـى التعـرف عليهـا عـن قـرب ليـدرك حقيقـة دورهـا ومـدى تأثيرهــا في الجتمــع الدولــي، ويكفينــا في هــذا التقــديم أن نشــير إلــى بعـض هـذه المواقـع والاماكـن لنـدرك ثـراء التجربـة وعظمتهـا، إذ نطالـع مسـيرة المؤلـف كمحكـم و محـام أمـام محكمـة العـدل الدوليـة بلاهـاي، وكأول أمـن عـام للمحكمـة الدسـتورية بمملكـة البحريـن، وكعضـو بلجنـة القانــون الدولــي للامم المتحــدة بجينيــف، وكرئيــس لمجلــس العقوبــات الخاصـة بكافحـة الفسـاد في إطـار البنـك الدولـي بواشـنطن.

لقـد سـاهم السـتاذ فتحـي كميشـة بأعمالـه في تكويـن الوعـي المسـتنير، وســاعد برأيــه الحــر في العديــد مــن القضايــا عبــر عقــود مــن الزمــن فـكان كاتبـا متفـردا ، وباحثـا متعمقـا ، ومحاميـا بارعـا ، ومفكـرا متحليـا برجاحــة العقــل.

وفي ختـام هـذه السـيرة المميـزة لا يوجـد مـا هـو أجمـل مـن عـودة صاحبهـا إلــى جــذوره بمدينــة القيــروان العتيقــة وانصرافــه إلــى زراعــة حديقتــه التــي يســتمر معهــا الغــرس والحصــاد تأكيــدا لقيــم العطــاء والاخــلص في العمـل.
